3.2 Strictly Prohibited Content

You must not use the Service to generate, upload, store, or distribute content that:

  • Depicts minors in any sexual or suggestive context whatsoever — this is an absolute prohibition, constitutes a criminal offence in most jurisdictions, and will result in immediate account termination and reporting to relevant authorities
  • Depicts real, identifiable individuals without their verifiable, documented consent
  • Constitutes non-consensual intimate imagery ("revenge porn") of real people
  • Constitutes harassment, stalking, or targeted abuse of any individual
  • Promotes, glorifies, or incites violence, terrorism, or hate against individuals or groups based on protected characteristics
  • Infringes any third party's intellectual property, privacy, or other rights
  • Violates any applicable local, national, or international laws or regulations

3.3 Enforcement

We use automated and manual moderation systems to detect prohibited content. Violations may result in immediate account suspension or permanent termination, content removal, reporting to law enforcement, and legal action. We cooperate fully with law enforcement investigations.

4. Intellectual Property & Ownership

4.1 Your Content

Subject to these Terms, you retain ownership of the images you generate using the Service. You grant us a limited, non-exclusive licence to store and display your generated content solely as needed to provide the Service to you.

4.2 Our Technology

The Service, including all AI models, software, algorithms, interfaces, and documentation, are owned by or licenced to us. You receive a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms. You may not reverse-engineer, decompile, copy, or create derivative works of our technology.

4.3 Commercial Use

Free tier users may use generated images for personal, non-commercial purposes only. Pro and Premium subscribers receive a commercial use licence for images generated during their active subscription period, subject to our Content Policy. You represent that your commercial use will comply with all applicable laws.

6. Subscriptions & Billing

  • Billing cycle: Subscriptions are billed monthly or annually as selected at purchase
  • Automatic renewal: Subscriptions renew automatically until cancelled
  • Cancellation: You may cancel at any time from your account settings. Access continues until the end of the current billing period
  • Refunds: We offer a 3-day money-back guarantee on first-time subscriptions. After this period, payments are non-refundable except where required by applicable law
  • Price changes: We will notify you at least 30 days before any price changes take effect
  • Failed payments: If payment fails, we will attempt to charge the payment method three times over 7 days before suspending your account

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

AI-generated images may contain errors, artifacts, or unexpected content. You are solely responsible for reviewing and approving any content before use.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Nude AI Generator BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless Nude AI Generator and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, your violation of any law or third-party rights, or any content you submit or generate.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising out of or in connection with these Terms that cannot be resolved informally shall be submitted to binding arbitration, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent infringement of intellectual property rights.

11. Modifications to Terms

We may revise these Terms at any time. Material changes will be communicated via email and/or a prominent notice on the Service at least 14 days before taking effect. Continued use of the Service after the effective date of revised Terms constitutes your acceptance.
